Nanindigan si House lead prosecutor at Batangas Rep. Gerville “Jinky Bitrics” Luistro na si Vice President Sara Duterte, bilang head ng Office of the Vice President (OVP) at dating kalihim ng Department of Education (DepEd), ang pangunahing mananagot sa paghawak ng confidential funds, anuman ang magiging testimonya ng dalawang dating special disbursing officers (SDOs) nito sa Senate Impeachment Court sa susunod na linggo.
Binanggit ni Luistro ang naging testimonya ni Commission on Audit (COA) State Auditor Roderick Wamil sa impeachment court na sa ilalim ng COA-Department of Budget and Management (DBM) Joint Circular No. 2015-01, ang head ng agency ang pangunahing mananagot sa confidential fund.
“Kahit magbago pa sila ng testimonya, klaro na ang naging position ng state auditor, the head of the agency remains to be one of the principally accountable parties,” diin ng lead prosecutor sa online press briefing nitong Huwebes.
“Iniutos man o hindi, maliwanag ang probisyon ng Joint Circular na nananati¬ling principally liable ang head of agency,” dugtong pa niya.
Sa susunod na linggo, ihaharap ng prosekusyon sina dating OVP Special Disbursing Officer Gina Acosta at DepEd Special Disbursing Officer Edward Fajar¬da, bilang mga hostile witness.
“Apparently, they are considered as hostile witnesses. Hostile because they are attached, associated, and perhaps part ng mga naging proseso nitong alleged incidents in the Articles of Impeachment,” paliwanag ni Luistro.
Sa kabila nito, naniniwala ang chairperson ng House Committee on Justice na mahalaga ang magiging testimonya ng dalawang hostile witness dahil bilang mga SDO, sila ang direktang humawak ng confidential fund.
“As SDO, sila talaga dapat ang pinakanakakaalam what happened to these public funds. That’s why their sworn testimonies are really significant in this impeachment trial,” dagdag ni Luistro.
Umaasa rin si Luistro na hindi babaguhin ng dalawang hostile witness ang kanilang testimonya sa imbestigasyon ng House Committee on Good Government and Public Accountability noong 19th Congress.
“So sana maging consistent sila sa kung anong nasabi na nila before,” diin ng lady solon.
“I will not understand if after their clear narration of what happened during the hearing of the Committee on Good Government, ay biglang mababago ang kanilang kuwento,” dagdag pa niya.
Sa naturang imbestigasyon, sinabi ni Acosta na matapos nilang mapa-encash ang tseke, ibinigay niya ito sa noon ay OVP security officer na si Col. Raymund Dante Lachica bilang pagsunod sa utos ni Duterte.
Binanggit naman ni Fajarda sa nasabing hearing na matapos niyang mapa-encash ang tseke, ibinigay niya ito sa noon ay DepEd security officer Col. Dennis Nolasco sa utos umano ni Duterte.
