Senate review ng VFA aksaya lang ng oras – Drilon

MAGSASAYANG lang ng oras ang Senado sa pagreb­yu ng Visiting Forces Agreement (VFA) kung talagang ipinag-utos ni Pangulong Rodrigo Duterte na ipawalang bisa na ang treaty sa pagitan ng Pilipinas at United States, ayon kay Senate Minority Leader Franklin Drilon.

“I will wait for the announcement of the President. If the President directs the termination of the VFA, a Senate review of the agreement is a waste of time,” pahayag ni Drilon.

At kung wala na ang VFA, ayon kay Drilon, hindi na titindig pa ang EDCA o Enhance Defense Cooperation Agreement.

“Without the VFA, EDCA cannot stand legally. EDCA is an executive agreement. The legality of EDCA is drawn principally from the VFA,” sabi ni Drilon.

Ayon kay Drilon, noong 2016, pinagtibay ng Sup­reme Court ang legalidad ng EDCA dahil may existing treaty ang US at Pilipinas na nauna nang pinagkasunduan ng Senado – ang VFA.

“The Supreme Court in 2016 upheld the legality of EDCA because the US and the Philippines have an existing treaty that is already concurred into by the Senate, which was the VFA,” sabi ni Drilon.

“Specifically, the Supreme Court, in Saguisag v. Executive Secretary ruled, EDCA seeks to be an instrument that enumerates the Philippine-approved activities of U.S. personnel referred to in the VFA,” saad pa nito.

Kung mapawalang bisa na ang VFA, sigurado aniyang ‘dead’ na rin ang EDCA.
“Without the EDCA, MDT is rendered inutile. I agree with Foreign Affairs Secretary Locsin that without the VFA and EDCA, MDT is just a piece of paper,” ayon kay Drilon.
