Biniling bahay at lupa paano mapapakansela?

Dear Atty. Claire.
Magandang araw po sa inyo magtatanong lang sana ako tungkol dito sa ikenansela naming house and lot.

Na-acquire namin ang nasabing property last june 2016 at nakapagbayad kami ng downpayment in cash, insurance, home owner membership at one month in house amortization. Bale ang total amount na naibigay namin sa deve­loper ay around 420K. Kinausap namin ang developer para sa cancellation, at sa ngayon ay dalawang buwan na kaming tumigil sa pagbabayad dahil sa hindi pa nila nasisimulan ang pag-develop at dapat ay matapos ito ng December 2016.
Bumalik po ang misis ko sa opisina ng developer upang itanong kung meron kaming puwede ma-irefund ang sagot nila wala raw, dahil hindi kami nagbayad 24 month na downpayment at hindi raw kami sakop ng RA 6552.

Totoo po ba ito at saka papaano ba ang legal na paraan para sa pagkakansela ng nasabing property?

Totoo na hindi kayo sakop ng RA 6552 o mas kilala bilang Maceda Law dahil ayon sa batas na ito ay mabibigyan ng proteksyon ang mga buyer in instal­lment basis kapag nakapagbayad na ng 2 years installments:
Section 3. In all transactions or contracts involving the sale or financing of real estate on installment payments, including residential condomi­nium apartments but excluding industrial lots, commercial buildings and sales to te­nants under Republic Act numbered thirty-eight hundred forty-four, as amended by Republic Act numbered sixty-three hundred eighty-nine, where the buyer has paid at least two years of installments, the buyer is entitled to the following rights in case he defaults in the payment of succeeding installments xxx

b) If the contract is canceled, the seller shall refund to the bu­yer the cash surrender value of the payments on the property equivalent to fifty percent of the total payments made, and, after five years of installments, an additional five percent every year but not to exceed ninety per cent of the total payments made: Provided, That the actual cancellation of the contract shall take place after thirty days from receipt by the buyer of the notice of cancellation or the demand for rescission of the contract by a notarial act and upon full payment of the cash surrender value to the buyer.

Dahil sa hindi ka sakop ng RA 6552 ay ipapayo na ang gamitin mong batas na ayon sa sitwasyon mo ay ang Civil Code kung saan binibigyan ng karapatan ang isang party na ipawalang saysay ng kontrata kung hindi nakatupad o hindi na makakatupad ang kabilang party sa kanyang obligasyon.

Art. 1191. The power to rescind obligations is implied in reciprocal ones, in case one of the obligors should not comply with what is incumbent upon him.

The injured party may choose between the fulfillment and the rescission of the obligation, with the payment of damages in either case. He may also seek rescission, even after he has chosen fulfillment, if the latter should become impossible.

Sa sitwasyon mo, kung ang developer ang may pagkukulang ay makukuha mo nang buo ang naibayad mo at maaari pang humi­ling ng interes.
