Good day po Atty. AGA. Ang tanong ko po ay tungkol sa lugar kung saan maaaring ganapin ang civil wedding.

Sa bulwagan lang po ba pwede? Maaari din po ba sa mga hotel, resort, restaurant or somewhere, basta po sakop ng judge ang jurisdiction nito?
Kasi po may nila­pitan po kaming judge,

ayaw pong magkasal sa resort kahit jurisdiction nya. Ngunit mayroon naman kaming nilapitan na judge na pumayag magkasal sa hotel o resort.

Ayon sa Article 8 ng Family Code, “The marriage shall be solemnized publicly in the chambers of the judge or in open court, in the church, chapel or temple, or in the office the consul-general, consul or vice-consul, as the case may be, and not elsewhere, except in cases of marria­ges contracted on the point of death or in remote places in accordance with Article 29 of this Code, or where both of the parties request the solemnizing officer in writing in which case the marriage may be solemnized at a house or place designated by them in a sworn statement to that effect.”

Malinaw na sinasabi ng batas na ang civil wedding ay maaring ganapin sa ibang lugar, maliban sa mga bulwagan o sala ng mga judge. Kailangan lamang na gumawa ng salaysay ang bride at groom na nagsasabing nagre-request sila sa judge na ganapin ang kasal nila sa gusto nilang lugar. Ngunit lagi nating tandaan na kapag ang solemnizing officer ay isang judge, may qualification ang Family Code dito.

Article 7 of the Fa­mily Code provides that, “Marriage may be solemnized by: (1) Any incumbent member of the judiciary within the court’s jurisdiction; xxx”. Ibig sabihin kapag ang judge ng MTC o RTC ay nag-so­lemnize ng kasal, ang lugar ay dapat sakop ng kanyang jurisdiction.

Kapag ang kasal ay ginanap sa lugar na ‘di sakop ng jurisdiction ng judge, hindi maapektuhan ang validity ng marriage. Ito ay tinatawag lamang na irregularity. Ang judge na ito ay magkakaroon ng administrative liability kapag napatunayang lumabag sya sa batas.

Noong taong 2007, inilabas ng Supreme Court ang Administrative Order No. 125-2007 to lay down rules to enable solemni­zing authorities of the Judiciary to secure and safeguard the sanctity of marriage as a social institution.

Ayon sa Section 2 ng nasabing Administrative Order, “Raffle of request for solemnization of marriages in multiple sala courts. – Requests for solemnization of marriages submitted to first and second level courts in stations with two or more branches shall be governed by the rules and procedures in the raffle of cases prescribed by exis­ting resolutions and ordinances. Raffle of requests shall be effected upon payment of the appropriate legal fees.”

Dahil sa Administrative Order na ito, ang mga couple na nais magkasal ng civil sa judge na nabibilang sa stations na may dalawa (2) o higit pang branches ay dadaan muna sa raffle. Sa raffle malalaman kung saang branch at kung sinong judge ang magkakasal sa kanila. Ang paggawa ng salaysay ng couple na nagre-request na ganapin sa isang lugar ang kanilang kasal ay kaila­ngan pa din isubmit sa judge na magso-solemnize ng kanilang kasal.
