Pinrotektahan ng
Korte Suprema ang magkapatid na magsasaka na pinaniniwalaang nauna
nang dinukot ng mga militar matapos na pagbawalan ang Department of
National Defense (DND) at Armed Forces of the Philippines (AFP) na
galawin ang mga ito.
Sa isang en banc
resolution, nagpalabas ng temporary restraining order ang Supreme
Court (SC) kung saan inuutusan ang DND at ang AFP na ipaaresto o
galawin sina Raymond at Reynaldo Manalo hangga’t dinidinig pa ang
kasong idinulog ng mga ito.
"... effective
immediately and continuing until further orders from this Court,
You, The Secretary of Department of National Defense and the Chief
of Staff, Armed Forces of the Philippines, your agents,
representatives, or persons acting in your place or stead, including
but not limited to the [Citizen Armed Forces Geographical Unit]
CAFGU, are hereby...enjoined from causing the arrest of petitioners,
or otherwise depriving, restricting, curtailing or abridging them of
their right to life, liberty and other basic rights," atas ng
SC.
Sa pamamagitan ng
Free Legal Assistance Group (FLAG) ay nagpasaklolo ang magkapatid sa
SC hinggil sa umano’y pagdukot sa kanila ng mga di-nakilalang
lalaki noong Pebrero 14, 2007 kung saan sangkot umano si Retired
Major General Jovito Palparan, Sgt. Rizal Hilario at iba pang
opisyal ng AFP.
Sa loob ng 18 buwan
na pagbihag sa kanila, isinalaysay ng mga Manalo na pawang torture
umano ang kanilang naranasan at kung hindi pa sila nakatakas noong
Agosto 13 ay posibleng patay na sila ngayon.
"Considering the
allegations contained, the issues raised and the arguments adduced
in the petition, it is necessary and proper to issue the temporary
restraining order prayed for," nakasaad sa resolusyon.
Sinuportahan naman ni
Bayan Muna party-list Rep. Satur Ocampo ang laban ng magkapatid na
Manalo. "The military has a lot of explaining to do in this
case," anang solon. |
